Signal Jammers in Benin: Current Laws and Regulations

Laws and Regulations Related to Signal Jammers

The use of signal jammers is considered illegal in Benin. The Law No. 2006-04 of January 26, 2006, on electronic communications and information society services expressly prohibits the manufacture, sale, possession, use, or importation of signal jammers. This law also states that anyone found in violation of these prohibitions will be subject to a fine ranging from 1,000,000 to 5,000,000 CFA francs (approximately 1,500 to 7,500 euros) and/or a prison sentence of six months to two years. In addition to the law on electronic communications, there are also other regulations that prohibit the use of signal jammers in certain circumstances. For example, the use of signal jammers is prohibited in correctional facilities, schools, hospitals, and airports.

Regulatory Bodies

The Regulatory Authority for Electronic Communications and Postal Services (ARCEP) is the government agency responsible for overseeing the use of radio frequencies and telecommunications equipment in Benin. ARCEP is also responsible for enforcing the laws and regulations regarding signal jammers. Violations of these rules are dealt with by the courts.

Obtaining Legal Authorization to Use a Signal Jammer

As mentioned earlier, the use of signal jammers is generally considered illegal in Benin. However, there may be exceptions for specific situations. For example, the use of signal jammers may be authorized for military or security operations. In such cases, the use of signal jammers must be approved by ARCEP.
