Regulation of Signal Jammers’ Use in Peru

Peru is a country located in South America, famous for its diverse landscapes, Inca archaeological sites, and colonial cities. The country has seen a rapid growth in the use of communication technologies in recent years, which has led to an increased interest in the use of signal jammers in various applications, including prisons, hospitals, shopping centers, cinemas, churches, and other public places. However, the use of signal jammers is regulated by strict laws to preserve the integrity of communication systems and ensure public safety.

Laws and Regulations Regarding Signal Jammers in Peru

In Peru, the use of signal jammers is strictly regulated by the Ministry of Transportation and Communications (MTC) through the National Institute of Radio Communications (INR), in accordance with Law No. 29525 on Communications and Information Technologies. This law was enacted in 2010 to regulate communications and information technologies within Peruvian territory. According to Article 118 of the law, the use, manufacture, import, sale, or commercialization of signal jammers without authorization is considered a violation of the current legislation and is subject to severe penalties, including fines and imprisonment.

Furthermore, in 2013, the MTC issued a resolution (Ministerial Resolution No. 292-2013-MTC/03) establishing the criteria and procedures for granting authorizations for the use of signal jammers. According to this resolution, the use of signal jammers is permitted in prisons, juvenile detention centers, social rehabilitation centers, temporary detention facilities, healthcare facilities, shopping centers, cinemas, churches, and similar public places. However, the use of signal jammers is prohibited on airplanes, ships, cars, and buses.

Obtaining Legal Authorization to Use a Signal Jammer in Peru

To obtain authorization to use a signal jammer in Peru, it is necessary to follow a strict procedure. Firstly, the applicant must submit an application to the INR, providing detailed information about the place of use, reasons for use, and technical specifications of the signal jammer. Then, the INR conducts a risk analysis to determine if the use of the signal jammer is justified and if it does not disrupt the communications of public safety or emergency services. If the application is approved, the applicant receives an authorization for the use of the signal jammer for a specific duration. The authorization must be renewed each year by providing updated information on the use of the signal jammer and paying the corresponding fees.
